1. General provisions

1.1. These Rules are developed in accordance with the Civil Code of the Russian Federation, Federal Law of the Russian Federation of 18.07.2019 No. 193-FZ "On Amendments to the Law of the Russian Federation on Culture" of the Law of the Russian Federation of 09.10.1992 No. 3612-1 "Fundamentals of the Legislation of the Russian Federation on Culture", Federal Law of the Russian Federation of 22.05. 2003 No. 54-FZ "On the use of cash register equipment in the implementation of cash payments and (or) payments using payment cards, the Charter of the Federal State Budget Institution of Culture "the North Caucasus State Philharmonic named after V. I. Safonov" (hereinafter referred to as the Philharmonic) and regulate the procedure for relations between the Philharmonic and Buyers (listeners) for the sale and return of tickets to concerts, festivals, performances, evenings, performances  (more—; events) held by the Philharmonic Society.

1.2. These Rules are brought to the attention of Buyers by posting on the official website of the Philharmonic Society www.kursal.ru. Also, any visitor to the Philharmonic can get acquainted with these Rules at the Philharmonic ticket offices located at the following addresses:

Kislovodsk, Karl Marx Ave., 3-A (Kurzal concert complex;)

g. Yessentuki, Kislovodskaya str., 2 (F. I. Chaliapin Concert Hall)

g. Pyatigorsk, Kirov Ave., 21A (Park «Flower Garden», concert hall «Lermontov Gallery»); Dunaevsky str., 5 (Park named after S. M. Kirov, concert hall « Tuning Fork»).

These Rules are the public offer agreement, the ticket purchase is unconditional acceptance of the Viewer all the terms of the Offer without any exceptions and/or limitations and is equivalent to a written agreement (p. S article 434 of the civil code). This Offer is considered the main document in the official relationship between the Philharmonic Society and the Buyer for the purchase and sale of tickets.

1.3. The Philharmonic Society undertakes to do everything possible to ensure that the events announced in the repertoire take place on the appointed days and times, at the proper artistic and performing level.

1.4. In exceptional cases, the Philharmonic reserves the right to make changes to the program of events, dates and composition of performers. Information about the changes is posted on the official website of the Philharmonic and at the Philharmonic ticket office.

2. Ticket sales procedure

2.1. You can buy tickets for the events at the Philharmonic box office, on the official website of the Philharmonic www.kursal.ru, from authorized persons acting on the basis of a civil contract, on the website of the official partner of the Philharmonic Society LLC "Exhibition Center" Caucasus " www.kupibilet.online.

2.2. The Buyer can check the availability of tickets for specific dates and events at the Philharmonic ticket office or on the Philharmonic's website.

2.3 Description and sample of tickets and season tickets purchased at the ticket offices of the North Caucasus State Philharmonic named after V. I. Safonov

2.3.1. The ticket or subscription is made on a strict reporting form in a typographic way. The ticket is printed on heat-resistant cardboard measuring 17 cm x 6.2 cm.

2.3.2. Back of the ticket and season ticket:

2.3.3. The front side of the ticket or season ticket must contain the following information:

- Event name;

- Event start date and time

- Ticket or subscription price (service cost);

Is the location (city, name of the hall)

- Row and placement in the hall;

- Ticket or season ticket number and series;

- Age limit of the event

As well as other information provided in accordance with the legislation of the Russian Federation.

2.4. Pre-order tickets for events can be made by calling the Philharmonic ticket offices in the cities:

The order is valid for 3 days. The Philharmonic reserves the right to refuse to place an order by phone without giving any reasons.

2.5. Daytime events of the Philharmonic (chamber and symphony concerts) can be attended by children from 6 years old accompanied by adults.If children break the silence and interfere with the concert, the Philharmonic reserves the right to ask the adults accompanying the children to take the children out of the hall.

2.6. Evening events of the Philharmonic Society (performances, operas, organ music concerts) can be attended by children from 12 years old if they have purchased tickets for them and are accompanied by adults. 

2.7.For school-age children, secondary school students, and full-time university students, tickets are purchased at a discounted price. 

2.8. Tickets for children's events of the Philharmonic Society for the age category 0+ are purchased for all children, regardless of their age.

2.9. In order to comply with the requirements of Federal Law No. 436-FZ of 29.12. 2010 On the Protection of Children from Information that harms their Health and Development, it is necessary to specify the age limit that allows children to observe information security at Philharmonic events. The specified information is contained in the posters, on the official website www.kursal.ru, on purchased tickets and season tickets. When buying a ticket, the viewer agrees to follow the age recommendations. The Philharmonic Society is not responsible for the violation of these recommendations by the audience.

2.10. By purchasing a ticket to an event held by the Philharmonic, the Buyer confirms the fact of concluding a contract for the provision of paid services in the field of culture with the performer (Philharmonic), as well as acceptance of these Rules.

2.11. A contract for the provision of paid services is issued by issuing a ticket and a receipt to the buyer (in accordance with Federal Law No. 54-FZ). A receipt is a document of the established form containing information about the terms of the contract with the consumer.

2.12. Tickets are sold by the Philharmonic both for cash and via bank cards (acquiring).

2.13. In order to provide access to the cultural life of the region to a greater number of listeners belonging to privileged groups of the population, and to regulate the rules for the sale of tickets to the events of the Philharmonic Society, a Regulation has been developed (ed. of December 23, 2019) On the procedure for selling tickets to privileged categories of citizens to events of the current repertoire of the North Caucasus State Philharmonic named after V. Tickets at discounted prices can only be purchased at the Philharmonic ticket offices before the start of the event, if documents confirming the right to grant benefits are provided. 

2.14. Tickets for touring events are sold by the official (- and)partner (s) of the North Caucasus State Philharmonic named after V. I. Safonov on the basis of contractual relations. Currently, these functions are performed by LLC "Exhibition Center "Caucasus".

LLC " VTS "Kavkaz" has the right, on the basis of contractual relations with the organizers of concerts and performances, as well as on the basis of Federal Law No. 54-FZ, to set a service fee for the sale of tickets using cash registers and online on the website www.kupibilet.online. The service fee is 10% of the ticket value. The amount of the service fee is the remuneration of the seller company for the sale of tickets (use of the premises, maintenance of cash register equipment, cash collection, payment of taxes, etc.).

3. Electronic ticket sales

3.1. Electronic ticket sales are carried out on the Philharmonic's website www.kursal.ru and on the official partner's website www.kupibilet.online.

3.2. The cost of electronic tickets on the Philharmonic's website www.kursal.ru corresponds to their cost at the Philharmonic box office.

3.3. You can buy a ticket on the event page by clicking "Buy a ticket" and then follow the information on the page. After the order is paid, a payment confirmation and a receipt will be sent to the email address specified by the buyer.

3.4. An electronic ticket is a document of the established form containing the following information:

- Event name;

- Event start date and time

- Ticket or subscription price (service cost);

Is the location (city, name of the hall)

- Row and placement in the hall;

- Ticket or season ticket number and series;

- Age limit of the event

As well as other information provided in accordance with the legislation of the Russian Federation.

3.5. When attending the event, you must present an electronic ticket to the usher in printed form or from the screen of a mobile device.

4. Ticket refund procedure

4.1. In accordance with the current legislation of the Russian Federation, the Civil Code of the Russian Federation, the Federal Law of the Russian Federation of 18.07.2019 No. 193-FZ "On Amendments to the Law of the Russian Federation on Culture", Article 521 of the Law of the Russian Federation of 09.10.1992 No. 3612-1 "Fundamentals of the Legislation of the Russian Federation on Culture", the ticket buyer has the right to unilaterally refuse to perform the contract for the provision of paid services and return the ticket or season ticket:

- no later than 10 days before the day of the event and get 100 percent of the ticket or season ticket price;

- get back at least 50 percent of the ticket or season ticket price less than 10 days, but not later than 5 days before the event day;

- less than five, at least three days before the day of the event, at least 30 percent of the ticket or season ticket price.

If the buyer refuses to attend the event less than 3 days before the day of the event, the Philharmonic Society has the right not to return the ticket or season ticket price to the buyer.

4.2. Due to the features of the subscription. The viewer is not entitled to claim the full or partial cost of the subscription in case of refusal to attend (regardless of the reasons) one or more events of the subscription. A refund of the full cost of the subscription is possible only before the start of the first subscription event in accordance with the conditions set out in Article 52.1 of the Fundamentals of the Legislation on Culture.

4.3. Tickets and season tickets purchased at the Philharmonic box office, on the official website of the Philharmonic, are subject to refund and exchange (www.kursal.ru) or from the authorized ticket distributors of the Philharmonic Society.

4.4.Tickets formed on a strict reporting form with an intact control coupon are accepted at the Philharmonic ticket office. Refunds are made at the Philharmonic ticket offices upon presentation of the passport. Tickets with taped, smeared or otherwise altered information about their cost are non-refundable.  

4.5. In case of damage, damage and loss of the check tickets, duplicates are not issued and the funds are not returned.

4.6. Instructions for returning e-tickets purchased on the website www.kursal.ru, sent to the buyer of the electronic ticket together with the ticket. The receipt of funds is carried out strictly on the bank card that was used to pay for electronic tickets within the time limits set by the issuing bank.

4.7. In the event of the buyer's refusal of the service, the funds for the purchased e-tickets will be returned under the conditions listed in clause 4.1.

4.8. In case of cancellation or postponement of the event, tickets are accepted within 10 days from the date of the scheduled date of the canceled (postponed) event.In this case, the cost of the tickets will be refunded to the buyer in full.

4.9. Tickets purchased at the Philharmonic box office or authorized representatives of the Philharmonic are returned at the Philharmonic box office.Refund procedure for tickets purchased on the website www.kursal.ru, specified in clause 4.6. Refund of tickets purchased through the Philharmonic partner's resource on the website www.kupibilet.online, carried out through the specified site. When returning tickets purchased through the website www.kupibilet.online, only the face value of the ticket is refundable. The service fee set by the official partner of the Philharmonic Society is non-refundable.

4.10. The Philharmonic is not responsible for tickets purchased from persons who are not official representatives of the Philharmonic and fake tickets.

5. Final provisions

5.1. These rules apply only to the sale of tickets for events organized by the North Caucasus State Philharmonic named after V. I. Safonov.

5.2. The Philharmonic Society has the right to make changes to the Rules for the Sale and Return of Tickets unilaterally, posting information about the changes at the box office and on the official website at least ten days before the new version begins.
